• Attempt to gain unauthorized access to any portion of the Services, other user accounts, or Cometly’s systems.

4.3 Distribution of Malware

• Upload, transmit, or distribute viruses, worms, Trojan horses, ransomware, spyware, or other malicious software.
• Intentionally introduce vulnerabilities to compromise system integrity.

4.4 Spamming and Unsolicited Communications

• Send unsolicited bulk or commercial messages (“spam”) through the Services.
• Use the Services to harvest email addresses or other contact information without consent.

4.5 Harassment and Hate Speech

• Engage in abusive, threatening, or harassing behavior towards other users or third parties.
• Post content that promotes hate, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.

4.6 Intellectual Property Infringement

• Upload, share, or distribute Content that infringes on the intellectual property rights of others, including copyrights, trademarks, or patents.
• Use the Services to distribute pirated software, media, or other protected works.

4.7 Misrepresentation and Fraud

• Provide false, misleading, or deceptive information about yourself or your business.
• Use the Services to facilitate scams, phishing attempts, or fraudulent transactions.

4.8 Privacy Violations

• Collect, store, or distribute Personal Data without proper consent or in violation of our Privacy Policy.
• Use the Services to stalk, monitor, or infringe upon the privacy of others.

4.9 Content Tampering and Defamation

• Alter or manipulate Content to deceive or defame others.
• Post defamatory statements or harmful misinformation about individuals or organizations.

4.10 Disruption of Services

• Interfere with or disrupt the functionality of Cometly’s Services, servers, or networks.
• Engage in Distributed Denial of Service (DDoS) attacks or other methods to overwhelm system resources.

5. Security Measures

To protect both Cometly and its users, the following security measures must be observed:

• Authentication: Use strong, unique passwords and enable multi-factor authentication (MFA) where available.
• Access Controls: Restrict access to sensitive Content and administrative functions based on role and necessity.
• Data Protection: Ensure that Personal Data is handled in accordance with our Data Processing Addendum (DPA).
• Reporting: Promptly report any security vulnerabilities, breaches, or suspicious activities to Cometly’s support team.

6. Monitoring and Enforcement

Cometly reserves the right to:

• Monitor user activities to ensure compliance with this AUP.
• Investigate any suspected violations or abuses of the Services.
• Take appropriate actions, including warnings, suspension, or termination of accounts, and legal action if necessary.

7. Consequences of Violation

Violations of this AUP may result in:

• Suspension or termination of access to Cometly’s Services.
• Legal action to recover damages or enforce compliance.
• Reporting to relevant authorities or regulatory bodies.

8. Exceptions

Certain activities may be exempt from this AUP under specific circumstances, such as:

• Law Enforcement Requests: Complying with lawful requests from law enforcement agencies.
• Court Orders or Subpoenas: Responding to judicial processes as required by law.
• Legitimate Business Purposes: Activities that are necessary for legitimate business operations and do not involve prohibited conduct.

9. Amendments to the AUP

Cometly may update this AUP from time to time to reflect changes in policies, laws, or business practices. Significant changes will be communicated via email or through our account dashboard. Continued use of the Services after such updates constitutes acceptance of the revised AUP.

10. Governing Law and Dispute Resolution

This AUP is governed by and construed in accordance with the laws specified in the Terms of Service. Any disputes arising under this AUP shall be resolved following the dispute resolution provisions outlined in the Terms of Service.

11. Severability

If any provision of this AUP is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

This AUP, together with the Terms of Service, Privacy Policy, and End User License Agreement (EULA), constitutes the entire agreement between you and Cometly regarding the acceptable use of our Services, superseding any prior agreements or understandings.
